Law Aspects of China´s Incorporation into the Global Trade System

Summary
The project will explore China´s trade commitments in the World Trade Organization (WTO) and evaluate the progress achieved by China in its institutional and legal area after 15 years of its entrance into the WTO. The project intention is to find out if China fulfils all criteria for being granted Market Economy Status (MES) that have the sense for carrying out trade defence investigations and to specify the impact of granting MES to China on the other WTO Members, with special attention paid to the Czech Republic and its industry. No law analysis in this area has been carried out until now. The results of law analyses assessing the influence of a state over economy resulted in the creation of a comprehensive register of laws that China has been implementing into the domestic law since 2001. The register will enable us to assess if China fulfilled the international commitments at its incorporation into the global trade system and transition to a market economy, to expose the hidden reserves in China’s law area and to create a new strategy for other trade negotiations with China.
